What are the rules to obtain a building permit?

The building permit is an administrative file that allows the administration to verify that your construction project complies with the urban planning rules of the municipality where it is located. In general, it concerns large-scale construction work (construction of a detached house and / or its annexes). However, it also applies to several other cases (certain enlargements, construction of a garden shed …)

The building permit application must be sent to the town hall via the Cerfa form n ° 13406 * 06.

In order to your file be complete and to your project have a chance of success, you must provide:

• A site plan of the ground [Art. R. 441-2 a) of the code of town planning]

The site plan must make it possible to precisely locate your land within the municipality in order to know what urban planning rules apply in the area where your project is located.

• A notice describing the land and the planned development project [Art. R. 441-3 of the code of town planning]

The notice is part of the development project. It presents the situation of the field. She presents the project, answering seven specific questions intended to enable the mayor or the prefect to understand how the planned developments fit into their environment. It allows you to specify the elements of your project that cannot be represented by the only plans of the current state of the ground and the overall composition plan.

The plan of the current state of the ground must show:

– the initial state of the land and its surroundings (existing construction, vegetation and landscape features).

– the layout or modalities of the connections of public facilities

– if the application doesn’t concern the totality of the land, the part of it that is not included.

• An overall composition plan of the project listed in three dimensions [Art. R. 441-4 2 ° of the urban planning code]

This plan allows to have a precise vision of your development project. It allows to see how your land will be after the completion of your development project.

• The report of the consultation [Art. L. 300-2 of the urban planning code]

When the project is the subject of a consultation, the request must include the report and conclusions of the consultation.

Your request must be made in four copies and must be filed at the town hall of the place of construction. It’s the decision maker of your project.

The period of instruction generally varies from 2 to 3 months from the date of filing the file, depending on the type of construction and the area where it will be built. Its validity period is 3 years.
